Liberal Senators Want Changes On Bill C-10

Senators Francis Fox and Wilfred Moore wish to amend Bill C-10, which is before the senate. The bill, passed in the House Of Commons with an overwhelming majority, concerns tax policy, including a controversial section which would limit government subsidies of films containing child pornography, graohic sex, extreme violence, or offensive content "contrary to public policy."
The senators would remove the right of the heritage minister to refuse tax credits based on "public policy" or to issue guidelines about film content, give producers an efficient judicial appeal mechanism if the minister blocks or delays funding, but would continue to prevent government funding of pornography, child pornography, and hate propaganda.
The bill has raised concerns that without tax-payer funded subsidies, the Canadian film industry will no longer produce risky or edgy movies, and that the industry would suffer for it. The arts community has also raised concerns about censorship.
Earlier, Heritage Minister Josée Verner dismissed suggestions that a proposed change to a federal tax credit system jeopardizes the creative freedom of Canadian film and television production. "We are far from censorship here. We are just putting forward an intention from our government and (from) the former Liberal government just to make sure that we will take fiscal measure to make sure that the Canadian taxpayers' money won't fund extreme violence, child pornography or something like that," she said at a press conferance. "The measure contained in Bill C-10 addresses only the most extreme and gratuitous material, not mainstream films such as Eastern Promises, Borderline, and Ma Fille, Mon Ange.
“The policy rationale for the ‘contrary to public policy’ provision is simple,” Verner said, according to a transcript of the proceedings. “It ensures that the government has the ability, in exceptional circumstances, to exclude certain material from public support. There is material that is potentially illegal under the Criminal Code, such as indecent material, hate propaganda, and child pornography. Currently, no provision in the Income Tax Act or regulations exclude such material. Bill C-10 addresses this loophole, in particular.”
The tax-credit program has contributed to more than 12,000 productions with a value of almost $22 billion since it was created in 1995. The Tax Credit Guidelines have deemed pornographic films not to be an “eligible genre” of production. Once a film is given a certificate of approval for production, however, the government currently has no avenue to enforce this or any other regulation after the film is completed.
Canada’s auditor general, Sheila Fraser, cites this process as one of the least accountable expenditures of government funds and recommends changes. In her audit of 2005, Ms. Fraser stated that the government cannot even be assured that it is funding real expenses.
A recent Compas poll revealed that 81% of Canadian either oppose subsidies for the offending films (72%) or support the subsidies but believe that individual taxpayers should be able to withhold their contributions to the film subsidy program as a matter of personal conscience (9%), with women more opposed than men.
Controversy also swirls around the role of Dr. Charles McVety of the Institute For Canadian Values (a well known anti-pornograghy organization). "I never met with that guy (McVety) and there's no meeting scheduled in my agenda . . . This is not a new bill, this is an intention announced in 2002/2003, and after that our government in 2006 adopted it in October in 2007 with the support of (all) parties," said Verner.
Dr. Charles McVety is a frequent contributor to The Canadian Times. Other supporters of the bill include REAL Women of Canada, the Canadian Family Action Coalition and social conservative groups..
Senators Francis Fox and Wilfred Moore said that they would send the Bill back to the House of Commons with their amendments, but are unlikely to do so before the fall.
